JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner prays for anticipatory bail in connection with Gaighat PS case no. 174 of 2016 registered for the offences punishable under Sections 465, 467, 468, 471 and 420 of the Indian Penal Code.

The allegation against the petitioner is that as per the direction of the High Court, all the panchayat teachers/ primary teachers were directed to file certificates with regard to their educational qualification but on verification of the certificates of the petitioner which was issued by Bihar Sanskrit Shiksha Board, the same is found to be forged.

No.52052 of 2016 (2) dt.21-12-2016 2/3 It has been submitted on behalf of petitioner that as a matter of fact, the certificate of the petitioner was earlier also verified by the concerned authority and the same was found genuine but when on direction of the Hon'ble Court the certificates were again verified, BSSB said that the same is not genuine. It is further submitted that due to aforesaid fact, the petitioner has again filed an application before BSSB for verification of her certificates which is still pending. It is further submitted that persons having similar allegation has moved before this Court and they were granted benefit of anticipatory bail and in support of his contention, learned counsel filed photo copy of the anticipatory bail bearing Cr. Misc. no. 22377 of 2016 and 21529 of 2016.

Having heard both sides and in view of the facts stated above and also considering the fact that matter of verification of the certificates of the petitioner is still pending, let the abovenamed petitioner, in the event of her arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Gaighat
