====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 29-01-2021 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking regular bail in connection with Goraul P.S. Case No. 404 of 2018 registered for offence punishable under section 394 of the Indian Penal Code. The petitioner has two criminal cases and allegation has been made that four criminal covering their face entered into the shop with the pistol, caught hold the informant and also assaulted him and at the point of pistol, they committed robbery and also took away his money and mobile set from the informant. The name of the petitioner has transpired during investigation.

From the case diary it appears that a gang is operating in that area and their basic job is to loot the shops and thereby earning amount.

Patna High Court CR. MISC. No.28000 of 2020(3) dt.29-01-2021 2/2 Learned counsel for the petitioner submits that the petitioner is in custody since 18.06.2019.

Looking to the nature of allegation as stated above, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, the court below is directed to conclude the trial within nine months from the date of receipt/production of a copy of this order. If the trial is not concluded within the aforesaid period, the petitioner will have liberty to renew his prayer for bail.
