The petitioner apprehends his arrest in connection with Gopalganj Town P.S. Case No. 302 of 2016 registered under Sections 419, 420, 467,468 and 353/34 of the Indian Penal Code. The accusation is that Jalkar in Kuchaikot Block was settled for the year 2012-13 to 2018-19 in favour of the petitioner but he did not deposit Rs.1,53,850/- in spite of several request. As such, petitioner committed the breach of trust. Learned counsel for the petitioner submits that it would appear from the F.I.R. that the dispute is of disobeying the agreement between the petitioner and the State of Bihar. Patna High Court Cr.Misc. No.53257 of 2016 (2) dt.16-12-2016 deposited by the petitioner, has already been deposited on 14.06.2016 in the District Nazarat, Gopalganj. Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Town P.S. Case No. 302 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
