Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Prosecution case as lodged by the police personnel is that on secret information the police intercepted a car under Registration No. HR13B4344 and recovered about 230 liters of

Learned counsel for the petitioner submits that petitioner is neither owner of the said vehicle nor he is concern with the seized liquor. Petitioner had gone to Varanasi and wherefrom he has taken left of the car. He submits that driver of the said vehicle was said to be fled away. He further submits that there is no recovery from the conscious possession of the petitioner, bears no criminal antecedent and he is languishing in judicial custody since 21.03.2020.

Petitioner is agreed to deposit a sum of Rs.20,000.00 (Rupees Twenty Thousand) in the Chief Minister Relief Fund, Bihar, bearing Account No.2065104000002257, IFSC IBKL0002065, IDBI Bank, Kidwaipuri Branch, Patna. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-5th-cum-Special Judge, Excise Act, Kaimur at Bhabua in connection with Excise Case No. 275 of 2020 arising out of P.R. Case No. 25 of 2019-20. The bail bond of the petitioner shall be accepted by the learned Court below on showing receipt of deposit of
