2. The petitioners seek regular bail in a case registered for the offence under Sections 189(2), 126(2), 115(2), 118(1), 109, 103(1), 76, 352, 351(2) & 190 of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, nine persons are said to have assaulted the deceased. The deceased has sustained only one injury which is on his head.

4. Learned counsel for the petitioners submits that the prosecution case is falsified from the post-mortem report and the petitioners are in custody since 23.01.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, East Champaran, Motihari/concerned Court below in connection with Kesariya P.S. Case No. 270 of 2024 subject to condition that:- (i). The petitioners will cooperate in trial and shall be represented on each and every date fixed by the Trial Court through their lawyer or through themselves.
