2. This application has been filed for quashing of the order dated 17.10.216 passed in G.R. No. 1164 of 2016/Tr. No. 1887 of 2016 arising out of Mahila P.S. Case No. 20 of 2016 passed by the learned Sub-Divisional Judicial Magistrate, Aurangabad whereby and whereunder the learned Magistrate, having found prima facie case, has taken cognizance against the petitioner for the offences punishable under Section 342 and 376 of the IPC and consequently, summons was issued against the petitioner.

3. This criminal miscellaneous petition is disposed of with a liberty that the petitioner may raise his points at the appropriate stage.
