Petitioners apprehend their arrest in a case registered for the offence punishable under Section 419, 420 of the Indian Penal Code.

As per the prosecution case, under scheme of Mukhya Mantri Gramin Payjal Nischay Yojna in the ward No.1 of Gram Panchayat, Kant irregularity and embezzlement has been done by these petitioners and one other accused person. It is submitted that petitioner No.1 is president of Ward Implementation and Management Committee of the Kant

Patna High Court CR. MISC. No.36664 of 2021(5) dt.05-07-2022 2/2 Panchayat and petitioner No.2 is Secretary. It is further submitted that petitioners have already completed the work and certificate to this effect has been given by Block Development Officer on 07.12.2019 (Annexure-9 to the supplementary affidavit). Petitioners have got no criminal antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Brahmpur PS case No.662/2020, subject to conditions laid down u/s 438(2) of the Cr.
