Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under section 302, 120B read with 34 of the Indian Penal Code and 27 of the Arms Act. As per the prosecution case, on information, the police reached near Harpur Nahar pool and found two persons being injured fallen, One person was found dead and the other person disclosed his name as Lalu Yadav and the name of dead person as Sikandar Yadav. He further stated that they were

Patna High Court CR. MISC. No.27061 of 2022(2) dt.01-09-2022 2/3 smuggling illegal liquor and when they reached the bridge on scooty, five to six miscreants assaulted them and tried to snatch liquor, and in the meantime a miscreant shot Sikandar Yadav dead on the spot.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner has come up on the surface during the course of investigation. The petitioner is not named in the F.I.R . The petitioner is also accused in one more case which is related to Arms Act. The petitioner is in custody since 17.01.2022.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that one pistol and mobile phones were recovered from the possession of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below, Siwan in connection with Nautan P.S. Case No. 185 of 2021.
