This is a petition for grant of anticipatory bail for offence under Sections 341, 323, 324, 307 and 379/34 of the Indian Penal Code and 27 of the Arms Act.
Submission of the petitioner is that the petitioner is already on police bail granted during the course of investigation. After cognizance he apprehends arrest.
Since the petitioner is already on bail, this anticipatory bail application is not maintainable. Hence, this anticipatory bail application is dismissed as not maintainable.
The Court below shall consider the prayer for bail of the petitioner in the light of the judgment of this Court reported in 2004(3) P.L.J.R., 491 (Mahendra Prasad Singh Vrs. The State of Bihar).
