JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 This is an application for grant of anticipatory bail in connection with Darbhanga Sadar (Sonki) P.S. Case No. 347 of 2018, disclosing offences under Sections 304B/34 of IPC. Allegation against the petitioner, who happens to be the father-in-law and the case is of dowry death. There is an allegation of demand of Rs.1,00,000/- and a golden chain and further allegation is of assault and torture to the daughter of the informant. F.I.R. further disclosed that petitioner had gone to Delhi and from there he was instructed and on her instruction, mother-in-law and father-in-law set her on fire. Submission of the learned counsel for the petitioner is that F.I.R. itself shows that he was not present at the place of occurrence and further inquest report shows that she died due to electric shot circuit and considering the same, a compromise

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Darbhanga Sadar (Sonki) P.S. Case No. 347 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
