JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 26-04-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Araria P.S. Case No. 648 of 2016 registered under Sections 379 of the Indian Penal Code but, subsequently, Section 411 of the Indian Penal Code was added.

Considering the allegation made in the first information report that unknown accused took away motorcycle of the informant when he had visited Sadar Hospital for treatment

Patna High Court Cr.Misc. No.22142 of 2018 (2) dt.26-04-2018 and the name of the petitioners transpired in course of investigation, I am not inclined to grant them pre-arrest bail. Accordingly, the prayer for pre-arrest bail is rejected. In case the petitioners surrender and seek bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
