The present petition has been filed for restoration of a writ petition bearing C.W.J.C. No. 3416 of 2022 which has stood dismissed for want of prosecution vide order dated 28.11.2022.

The present counsel appearing in the matter submits that the Advocate on Record of the aforesaid writ petition has died, hence the aforesaid writ petition could not be diligently prosecuted, thus the same had stood dismissed for want of prosecution on account of nonappearance of the learned counsel for the

Patna High Court MJC No.1135 of 2023(2) dt.16-08-2023 2/2 petitioner, thus a sympathetic view be taken and the aforesaid writ petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the counsel appearing in the matter as also considering the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid writ petition bearing C.W.J.C. No. 3416 of 2022 to its original file.

The present petition stands allowed.
