2. The petitioner seeks regular bail in connection with Mufassil P.S. Case No. 398 of 2024 registered for the offence under Sections 103, 238, 3(5) of the B.N.S.S., 2023.

3. As per the prosecution case, the deceased was last seen with the petitioner but subsequently his dead body has been recovered. During investigation, the petitioner in his statement said that deceased had consumed some intoxicant and jumped into Gandak river.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner has no criminal antecedent. He further submits that during postmortem, it has come that the deceased died due to

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and also considering the period of custody, this application for regular bail is allowed.

7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Court of Sub Judge-V-cum A.C.J.M.-ii, Samastipur in connection with Mufassil P.S. Case No. 398 of 2024.
