JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-06-2018 The present writ petition has been filed for directing the respondents to grant the benefits of 3rd A.C.P. The learned Senior Counsel for the petitioner submits that in light of the order dated 15.05.2017 passed by this Court, the petitioner had filed a representation before the Respondent No. 2, however, the Respondent No. 2 has failed to dispose of the representation.

Having regard to the facts and circumstances of the case, the present writ petition is disposed of with a direction to the Respondent No. 2 to decide the claim of the petitioner within a period of four weeks from today by passing a reasoned and speaking order and taking into account the fact that the

Patna High Court CWJC No.15151 of 2010(5) dt.18-06-2018 2/2 petitioner has not been granted regular promotion and has completed the stipulated period for grant of the benefits of the 3rd A.C.P., hence the petitioner is definitely entitled for the same. In case, the Respondent No. 2 finds that the petitioner is entitled for grant of the benefits of 3rd A.C.P., the consequential benefits shall be paid within a period of four weeks thereafter.
