JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 The petitioner seeks regular bail in connection with Jehanabad P.S. Case No. 46 of 2015, registered for offences punishable under Sections 147, 148, 149, 323, 341, 342, 325, 427, 302 of the Indian Penal Code.

Allegation as per F.I.R. is that 100 to 150 persons assembled and assaulted the brother of informant causing his death.

It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petitioner and at best he can only be said to be member of mob and he has been in judicial custody since 28.01.2019 and similarly situated other accused persons have been enlarged on bail by coordinate Benches of this Court vide order dated 18.07.2016 passed in Cr. Misc. No. 26980 of 2016 and vide order dated 23.03.2018

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -III, Jehanabad, in connection with Jehanabad P.S. Case No. 46 of 2015, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
