JUSTICE RAKESH KUMAR ORAL ORDER 13-02-2018 Heard Sri Vibhuti Ranjan Sonvadra, learned counsel for the petitioners, learned Addl. Public Prosecutor as well as learned counsel appearing on behalf of the informant. Three petitioners, apprehending their arrest in Warsaliganj P.S. Case No.291 of 2017 registered for the offence under Sections 448, 341, 323, 504, 307/34 of the Indian Penal Code, have prayed for grant of bail, in the event of their arrest or surrender.

Learned counsel for the petitioners, by way of referring to the F.I.R. as well as injury report at page-21 of the petition, submits that both parties are close relative and on trivial dispute, occurrence had taken place, in which from both sides cases were

Patna High Court Cr.Misc. No.7007 of 2018(2) dt.13-02-2018 2/2 lodged. It has been argued that injuries found on the person of the informant side are not grievous, but simple in nature. Learned counsel for the informant has opposed the prayer for anticipatory bail. However, he was not in a position to dispute the fact that both parties; informant side and petitioners side are close relative.

Considering the fact that the dispute arose in between family members, the Court is of the opinion that no purpose would be served to send petitioners in jail. Accordingly, in the event of their arrest or surrender within a period of six weeks from today, let aforesaid three petitioners, namely, (i) Arjun Ram (ii) Sarwan Ram and (iii) Sanjay Ram be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-II, Nawada in connection with Warsaliganj P.S. Case No.291 of 2017, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
