Heard learned counsel for the appellant and learned counsel for the State.

A mention slip has been filed on behalf of the appellant stating that the appellant was granted bail by this Court vide order dated 01.10.2020 and in the said order, the name of the father of the appellant has been stated as 'late Banarsi Prasad Gupta' but the informant in the F.I.R. has mentioned the name of the father of the appellant as 'Jagdish Gupta'. By the said order, the appellant was granted bail to the satisfaction of learned A.D.J.-3rd-cum- Special Judge, SC/St Act, Bhagalpur in connection with Kahalgaon P.S. Case No. 136/2020. Learned

Patna High Court CR. APP (SJ) No.1458 of 2020(3) dt.02-11-2020 2/2 counsel for the appellant further submits that due to difference in the father's name of the appellant, the bail bonds of the appellant has not been accepted by the Court below. From perusal of the record as well as submission made on behalf of the appellant, it is apparent that the correct name of the father of the appellant is late Banarsi Prasad Gupta and not Jagdish Gupta.

Further, it is clarified that the name of the father of the appellant is Late Banarsi Prasad Gupta and not Jagdish Gupta. The order dated 01.10.2020 passed in Cr. Appeal (SJ) No. 1458 of 2020 is clarified to the extent as indicated above. (Sudhir Singh, J) Pankaj/- U T
