The petitioner seeks regular bail in connection with Panjwara Police Station Case No. 95 of 2018, registered for the offences punishable under Sections 395/34 of the Indian Penal Code.

The allegation, as per the First Information Report, is that the informant, being the Manager of Bharat Finance Inclusion Limited, was going to bank to deposit the amount and on the way, he was intercepted by two miscreants, who looted away a sum of Rs. 1,22,542/-, along with two mobile phones having four SIM cards, on the gun point.

No.27769 of 2020(2) dt.05-11-2020 2/3 Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has got no criminal antecedent. He further submits that the petitioner's name has transpired on the basis of the confessional statement of co-accused Bharat Bhushan, who was granted bail by this Court, vide order, passed in Criminal Misc. No. 14128 of 2019. He further submits that charge sheet has already been submitted against the petitioner and other coaccused persons have been granted bail by this Court. After having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that co-accused Bharat Bhushan, on whose confessional statement the name of the petitioner has transpired, has been granted bail by this Court, I am inclined to grant bail to the petitioner.

This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Panjwara Police Station Case No. 95 of 2018.

This is subject to the condition that the petitioner shall

It is further made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding social distancing.
