The petitioner is apprehending his arrest in connection with Surajgarha P.S.Case No. 171 of 2014 registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code and later on Section 304B IPC was added. It has been submitted on behalf of the petitioner that the petitioner is brother-in-law and is living separately from the deceased and her husband. However, he has been falsely implicated in this case.
Heard learned APP also.
Having heard both sides and after perusal of the FIR it appears that the allegation is against this petitioner that he sprinkled kerosene oil on the deceased and her husband set her on
Patna High Court Cr.Misc. No.55570 of 2016 (3) dt.31-01-2017 2/2 fire, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.
The petitioner may surrender in the court below and pray for bail, which shall be considered and disposed of on its own merit, without being prejudiced by this order. (Vinod Kumar Sinha, J) spal/- U
