The petitioner seeks bail in connection with Musrigharari P.S. Case No. 94 of 2018 instituted for the offence under Section(s) 273 of the Indian Penal Code and Sections 30(a)/37(a)/38/41 of Bihar Prohibition & Excise Act, 2016. It is alleged in the written report that police got secret information that in the campus of Maa Kamakhya Line Hotel a Pick-up van is standing loaded with huge quantity of wine. Thereafter police party reached at the place of occurrence and apprehended one person who disclosed his name as Arun Choudhary, who was sitting in the aforesaid pick-up van. The police recovered 958.32 litres of foreign liquor from the aforesaid pick-up van. The apprehended person disclosed that

Learned counsel for the petitioner has submitted that there is no recovery of any incriminating article from possession of this petitioner.

Petitioner is in custody since 18.03.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II cum Special Judge (Excise Act), Samastipur in connection with Musrigharari P.S. Case No. 94 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioner.
