JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307 and 504/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

The prosecution case is that the accused persons came and asked the informant to vacate the land and started abusing. On protest being made the accused persons assaulted the informant,

Patna High Court Cr.Misc. No.345 of 2016 (2) dt.07-01-2016 2/2 her husband, father in law and other family members and abused by calling the caste name. It is further alleged that they snatched five thousand rupees from the husband of the informant. Five persons received injuries from the informant side. It is submitted by the learned counsel for the petitioners that in the background of land dispute the accusation has been levelled. There is counter version of the occurrence and the petitioners side also received injury.

It is submitted by the learned counsel for the informant that out of five persons, one person received grievous injury. Let the learned court below consider the prayer for regular bail of the petitioners in view of the fact that the accusation has been levelled in the background of land dispute between the parties in case the petitioners surrender within six weeks from today in connection with Laxamipur P.S. Case No.165 of 2015 pending in the court of learned S.D.J.M. Jamui.

This application is disposed of with the aforesaid observation/direction.
