23-09-2016 The petitioner apprehends his arrest in relation to Mahila P.S. Case No. 59 of 2016 registered under Sections 376, 511, 354(B), 323 of the Indian Penal Code.

Learned counsel for the petitioner has drawn attention of the court to the fact that though the incident is said to have been taken place on 14.06.2016, and also there was a Panchayati on 18.06.2016. The First Information Report is lodged on 12.07.2016. There is no explanation why this delay. It is then pointed out that even in the First Information Report no offence or an attempt thereof is made out in relation to Section 376 of the I.P.C., at best, it could be a case of trying outrage the modesty of a lady. It is submitted that petitioner has

Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner, namely, Md. Lalu, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Katihar, in connection with Mahila P.S.
