Petitioner is apprehending arrest in connection with Bounsi P.S. Case No. 59 of 2017 for the offence under sections 366(A), 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that girl has joined wedlock at her own sweet will with one Chhotu Mandal. In the statement recorded under section 164 Cr.P.C. the victim girl has not levelled any allegation against this petitioner. In view of the fact that the girl has joined wedlock at her sweet will and the fact that similarly circumstanced co-accused Arun Mandal was granted anticipatory bail by this court vide order dated 17.10.2017 in Cr. Misc. No. 47695 of 2017 and as such on the ground of parity, this court is inclined to grant bail

Patna High Court Cr.Misc. No.5641 of 2018(3) dt.27-02-2018 2/2 to the petitioner named above, in the event of arrest/surrender before the court below within a period of one month from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Banka, in connection with Bounsi P.S. Case No. 59 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C.
