The petitioner seeks bail in connection with Special Excise No. 498 (A) of 2021 arising out of Banka (Barahat) P.S. Case No. 537(A) of 2021 registered for the offence under Sections 30(a) / 32(2) of Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 29.01.2023 and there is recovery of 172.50 liters of illicit foreign liquor.

Learned A.P.P. has vehemently opposed the prayer for bail.
