This writ petition was filed on 11.12.2013 with two advance copies to the office of the Advocate General. Unfortunately, even after five years the respondents have not filed any counter affidavit.
Learned counsel for the petitioner submits that the present writ petition is covered by the orders of this Court dated 1.5.1995 passed in CWJC No. 3633 of 1994 and 02.07.2009 passed in CWJC No. 13615 of 2001 as contained in Annexures- 4
Patna High Court CWJC No.24777 of 2013 dt.17-09-2018 2/2 and 5 respectively. Counsel further submits that the petitioner has filed representation addressed to the District Programme Officer (Establishment) Begusarai on 18.6.2012, which has not been disposed of as yet.
Considering the aforesaid, the writ petition is disposed of with a direction to the District Programme Officer (Establishment) Begusarai to examine the case of the petitioner and if the case of the petitioner is covered by the orders Annexures- 4 and 5, necessary order may be passed by the respondents on the representation of the petitioner. It is clarified here that while taking decision the District Programme Officer (Establishment) Begusarai is required to obtain approval of the Director, Primary Education while granting consequential benefits to the petitioner. Final decision in this regard must be taken by the respondents within a maximum period of four months from the date of receipt/production of a copy of this order.
