JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-08-2019 The petitioner, who is the husband of the deceased, seeks bail in connection with Singhwara P.S. Case No. 190 of 2017, dated 06.11.2017, which initially was instituted for the offences under Sections 307, 323, 336, 341, 498(A) and 504/34 of the I.P.C., but with the death of the deceased, Section 302 of I.P.C. was also added. It has been submitted on behalf of the petitioner that on the day of the occurrence, he was away at Goa in connection with his service and because of an accidental burn injuries suffered by the deceased, the entire family has been made accused in this case. It has further been submitted that all efforts were made to provide medical aid

From the perusal of the F.I.R. as also the order impugned in the present petition, it appears that the deceased narrated about the occurrence of assault by the husband, when he had come back home in an inebriated condition, to her father, who is the informant of this case. Considering the nature of injuries suffered by the deceased and the statement made by her while she was alive, to her father, who is the informant of this case, I am not inclined to grant the petitioner the privilege of bail for the present, even though he is stated to in custody since 28.01.2019.

The prayer for grant of bail of the petitioner is, accordingly, rejected.

The petition is dismissed.
