JUSTICE ARVIND SRIVASTAVA ORAL ORDER 27-11-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Saharsa Sadar P.S. Case No. 973 of 2016 registered for the offence punishable under sections 341, 323, 384, 386, 387, 504 and 506/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner alongwith his family members have been falsely implicated in this case due to previous enmity. Earlier a case was lodged by the brother of this petitioner against the present informant in connection with demand of Rangdari and in retaliation the present case has been lodged. No one has sustained any injury.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner,
Patna High Court Cr.Misc. No.37052 of 2017(4) dt.27-11-2017 2/2 above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 973 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
