Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Jamalpur (Bargaon O.P.) P.S. Case No. 04 of 2023 registered on 08.01.2023 lodged under Sections 406, 409, 420, 467, 468, 34 of the I.P.C.

As per the prosecution case, the allegation of interposition in the name of beneficiary are there against the petitioners and others.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is a teacher and he is in custody since

Patna High Court CR. MISC. No.28003 of 2023(2) dt.07-06-2023 2/2 24.01.2023. He further submits that charge sheet has already been filed in this case. Counsel submits that there is no chance of absconding or tempering of the evidence by the petitioner. Counsel submits that the other accused person has been granted bail by the Co-ordinate Bench of this Court vide order dated 23.05.2023 in Cr. Misc. 27008 of 2023.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case, considering the period of custody and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Biraul, Darbhanga in connection with Jamalpur (Bargaon O.P.) P.S. Case No. 04 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
