The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 224, 225, 353, 34 of the Indian Penal Code.

As per prosecution case, this petitioner alongwith other F.I.R. named accused persons forcibly got released two co-accused persons from the custody of police. It is submitted on behalf of petitioner that petitioner is only alleged to be member of the mob and there is no specific allegation of any overt act against him. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.27995 of 2022(2) dt.22-09-2022 2/2 Considering the aforesaid facts and circumstances as well as clean antecedent of petitioner, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Gaighat P.S. Case No. 12 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
