JUSTICE PURNENDU SINGH ORAL ORDER 07-05-2025 Heard Mr. Deepankar Raj along with Mr. Ashutosh Kumar Upadhaya, learned counsels appearing on behalf of the petitioner and Mr. Mr. Anant Kumar 1, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Bhabua P.S. Case No. 01 of 2025 registered for the offence(s) punishable under Sections 70(1), 126(2), 115(2), and 351(2) of the BNS and Section 4/8 of POCSO Act.

3. As per the allegation made in the FIR, four accused persons named therein including the petitioner had kidnapped the minor girl/victim and thereafter raped her.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6.Considering the nature of allegation made against the petitioner, I am not inclined to grant pre-arrest bail to the petitioners.

7. Accordingly, the present bail application stands dismissed with a liberty to the petitioner to avail the appropriate remedy in accordance with law.
