The petitioners seek anticipatory bail in a case instituted for the offence under Sections 341, 323, 447, 379, 385, 354B, 504 and 34 of the Indian Penal Code.
It is alleged in the written report that on the date of occurrence, the petitioner entered into the house of the informant, abused and assaulted him and other family members. They also outraged the modesty of the family members and demanded 2,00,000/- ransom from the informant. It has further been alleged that they have also committed theft of cash and ornaments and threatened the informant with dire consequences.
Patna High Court Cr.Misc. No.596 of 2017 (3) dt.02-02-2017 2/2 The counsel for the State has submitted that there is no any injury report in the case diary. From the written report, this Court finds that there is general allegation against the petitioner. It has been submitted that except one case pending against the petitioner No. 1 in which he has been granted bail, the petitioners have clean antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Sultanganj P.S. Case No. 117 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bhagalpur, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
