JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Mehndiya P.S. Case No. 68 of 2016 registered under Sections 341, 323, 307 and 506 of the Indian Penal Code. The accusation is that due to grudge of election of Secretary of the Mosque, petitioners came armed with iron rod and gave rod blow at the informant Md. Jakir Husain, his father Md. Mahbool Haque and brother Md. Rasid causing grievous injury. Learned counsel appearing on behalf of the petitioners submits that admittedly, the occurrence took place due to differences in election of Secretary of the Mosque, in which petitioners' side also sustained injury regarding which Mehndiya

Patna High Court Cr.Misc. No.53213 of 2016 (2) dt.08-12-2016 2/2 P.S. Case No. 69 of 2016 is also instituted. Further, submission is that injuries, as found on the person of the informant, his father and brother, are of simple in nature caused by hard and blunt substances.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Arwal in connection with Mehndiya P.S. Case No. 68 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
