JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 08-09-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 392, 412 and 504 of the Indian Penal Code.

As per the prosecution case, two miscreants boarded on motorcycle came and started abusing and assaulting the informant and fled away but after half kilometer one miscreant was apprehended by the police who disclosed his name as this petitioner Akhtar Miya and also disclosed the name of the other

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The seized vehicle does not belong to the petitioner rather it belongs to the one Bishnu Deo Yadav. The petitioner is accused in three other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 22.03.2022.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below, Khagaria in connection with Chautham P.S. Case No. 331 of 2020. The application stands allowed.
