The petitioners seek bail in connection with Government Official Case No. 54 of 2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

According to the FIR, the petitioners have been found to be in possession of 178.5 litres of Nepali liquor. Learned counsel for the petitioners has submitted that such recovery has wrongly been foisted on the petitioners.

They are persons of clean antecedents and are in custody since 21.03.2020.

Regard being had to the aforestated facts

Patna High Court CR. MISC. No.25277 of 2020(2) dt.30-09-2020 2/2 especially the period of custody of the petitioners, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IIcum- Special Judge (Excise Act), Sitamarhi in connection with Government Official Case No. 54 of 2020.
