2. The petitioner has preferred this application for grant of regular bail in connection with Kalyanpur P.S. Case No. 149 of 2023 dated 08.05.2023 registered for the offences punishable under Sections 414, 420, 467, 468, 471 read with Section 34 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act.
3. As per the prosecution case, on secret information that the petitioner and the co-accused persons engaged in unloading and distributing the liquor consignment to other small traders. When the informant raid the place of occurrence, three persons were apprehended and from them, one country-made
Patna High Court CR. MISC. No.25661 of 2025(2) dt.06-05-2025 2/3 pistol and live cartridge were recovered and the apprehended coaccused, Prabhat Chaudhary disclosed the name of the petitioner and the other accused persons, who fled away from the place of occurrence.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. The name of the petitioner has been transpired in this case in the confessional statement of the co-accused Prabhat Chaudhary. The petitioner has no concern with the alleged occurrence. The petitioner has seven criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 22.11.2024. The co-accused person has already been granted anticipatory bail by Co-ordinate Bench of this Court vide order dated 22.08.2023 passed in Cr. Misc. No. 43918 of 2023.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.25661 of 2025(2) dt.06-05-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Samastipur in connection with Kalyanpur P.S. Case No. 149 of 2023, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
7. The application stands allowed.
