NILU AGRAWAL ORAL ORDER 29-09-2016 Heard learned counsel for the petitioners and learned A.P.P. for the State.

Petitioners apprehend their arrest in Piro P.S. Case No.134 of 2015 registered for the offences punishable under Sections 447, 341, 323, 504, 354, 342, 506 and 325/34 of the Indian Penal Code and Section 3⁄4 of Witch Craft Act. The prosecution case, in short, is that the petitioners along with co-accused abused and dragged out the informant from her courtyard and assaulted her and locked her in their house. The petitioners called the informant witch and on hearing that the police had come and released the informant from the clutches of the petitioners.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.37541 of 2016 (2) dt.29-09-2016 2/2 petitioner that they are innocent and have been falsely implicated in the aforesaid case. He submits that no offence under Section 354 of the I.P.C. is made out against the petitioners and Section 3⁄4 of Witch Craft Act is supper addition as the allegation of calling her witch is concocted. He further submits that the injury found on the informant is abrasion and swelling.

Learned A.P.P. for the State submits that the petitioners are named in the first information report and hence, opposes the prayer for bail.

Be that as it may, let the petitioners, above named, in the event of their arrest or surrender before the court below within eight weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of like amount each to the satisfaction of the learned A.C.J.M.,-1, Bhojpur at Ara, in Piro P.S.Case No.134 of 2015 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
