2. The present writ petition has been filed for the following reliefs :- (i). For directing the respondents to post the petitioner in the office of Civil Surgeon cum- Chief Medical Officer, Munger commensurate to his post of Assistant Administrative Officer on the ground that the petitioner is senior most clerk in the Cadre under Munger District and is being forced to discharge the duty of Upper Division Clerk in the office of
Patna High Court CWJC No.7536 of 2025(2) dt.18-06-2026 2/3 Superintendent, Sadar Hospital, Munger.
(ii). For any other relief/ reliefs if petitioner is found entitle in the facts and circumstances of the present case.
3. Learned counsel for the petitioner submits that a counter affidavit has been filed, in which Annexure-C has been annexed. Counsel further submits that in Annexure-C, a request has been made to the Director-in-Chief to do the needful so that the grievance of the petitioner and others may be redressed. Counsel further submits that as soon as the Director-in-Chief takes a decision in light of Annexure-C, the grievance of the petitioner shall automatically stand resolved.
4. Learned counsel for the State, on the other hand, submits that the details of the available promotional posts have been sought from the regional office, and as soon as the said posts are identified, a decision shall be taken at the level of the Director-in-Chief.
5. After hearing the parties, it transpires to this Court that keeping the present writ petition pending shall serve no useful purpose.
6. Therefore, the Director-in-Chief, Disease Control, Public Health Para Medical, Health Services, Health
Patna High Court CWJC No.7536 of 2025(2) dt.18-06-2026 3/3 Department, Government of Bihar, Patna (Respondent No. 3), is hereby directed to do the needful within six months from today so that the grievance not only of the petitioner but also of other persons who have been promoted may be resolved.
7. It is made clear that if the said decision is not taken within the stipulated time, Respondent No. 3 shall be liable for contempt proceedings.
8. Accordingly, the present writ petition stands disposed of.
