====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-05-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 326, 354, 379, 504, 506 of the Indian Penal Code.
3. As per the F.I.R., on the alleged date and time of the occurrence, these petitioners committed maar-peet with the informant and her family members.
4. Learned counsel for the petitioners submits that both parties are neighbours and due to petty dispute, this false and concocted case has been lodged against the petitioners. Allegation of assault against the petitioners is general and omnibus. He further submits that as per the F.I.R., alleged occurrence took place on 01.12.2023 but F.I.R. was lodged on
Patna High Court CR. MISC. No.34306 of 2024(2) dt.23-05-2024 3/3 09.12.2023, i.e. after inordinate delay of eight days, which itself creates doubt about the veracity of the prosecution case. Petitioner Nos. 2 to 22 claim clean antecedent and petitioner No. 1 has got one criminal antecedent in which he is on bail.

Considering the nature of accusation and delay in lodging the F.I.R., this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P. S. Case No. 319 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
