====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------- 13-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Ghoghardiha P.S. Case No.68 of 2017 registered under Sections 20(A), 21 and 22 of the N.D.P.S. Act.

In course of patrolling duty, the police searched the betel shop from where 90 gram Ganja, kept in 28 Pudias, was recovered. One person, who was sitting in the betel shop, was apprehended, who disclosed his name as Pankaj Jha, and also disclosed that the aforesaid Pudias of Ganja belong to the petitioner, who has gone to take the meal.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.48099 of 2017 (2) dt.13-10-2017 2/2 submits that it would appear from the F.I.R. that the petitioner was not apprehended from the shop from where the alleged recovery is said to be made. The name of the petitioner has been disclosed by the co-accused Pankaj Jha. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Madhubani, in connection with Ghoghardiha P.S. Case No.68 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
