For the Petitioner/s : Mr. Arvind Kumar For the Opposite Party/s : Mr. Smt. Pushpa Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-09-2016 Heard both sides.
The petitioner apprehends his arrest in Byepass P.S. Case No. 15 of 2015, registered for the offences punishable under Section 354 and other Sections of the Indian Penal Code. The informant alleged that her husband died in the year 2014 but on the death of her husband, the elder brother of her husband used to tease her and he always asked the informant to marry with him. The informant further alleged that on 22.02.2015, the petitioner abused her and caught her hand with bad intention. Learned counsel for the petitioner submits that the allegation made against the petitioner is false. The informant wanted to get partition of the land and that is why this false case has been lodged.
Patna High Court Cr.Misc. No.39332 of 2016 (2) dt.16-09-2016 2/2 It appears that the informant has made very specific allegation that after death of her husband, the petitioner used to torture her with bad intention and also caught her hand. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
