JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Amour P.S. Case No. 98 of 2016 registered under Section-376 of the Indian Penal Code.

According to the fardbyan of the informant, it was co-accused Md. Mojammil, who committed rape on the informant. So far as petitioners are concerned; it is alleged that they along with two others made abortive attempt to cause miscarriage of the informant.

Considering the above-said facts and circumstances of the case as well as submission of the parties, this anticipatory

Patna High Court Cr.Misc. No.44520 of 2016 (2) dt.02-12-2016 2/2 bail petition is allowed and it is ordered that the petitioners named above, in the event of their arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Amour P.S. Case No. 98 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Purnea subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
