JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-01-2022 Heard learned counsel for the petitioner and the CBI. Petitioner seeks bail in a case registered for the offences punishable under Sections 120B, 409, 467, 468, 471 of the Indian Penal Code and Sections 13(2) read with Section 13(1) (d) of the Prevention of Corruption Act.

As per the prosecution case, petitioner was one of the signatories of the cheques which led to the multi crore scame called Srijan Scam.

Learned counsel for the petitioner submits that the instant case arises out of multi crore SRIJAN scam. Petitioner was initially not named in the FIR, though, her name has come in the case during course of investigation in paragraph 16.1 of the chargesheet. She was the former president of Srijan Mahila Vikash Sahyog Samiti Ltd and as per the by-laws, she was the authorized signatory and was duty bound to sign the cheques. He further submits that the petitioner is 76 years old lady suffering from various ailments. She is not the beneficiary of the transactions in question and no incriminating material has been recovered from her possession. Petitioner is in custody since 28.11.2019. Charge sheet has already been submitted and petitioner is not required for custodial interrogation. Learned counsel for the CBI opposes the prayer for

Patna High Court CR. MISC. No.27891 of 2020(9) dt.04-01-2022 2/2 bail and submits that during investigation it has come that the petitioner, in a planned conspiracy, facilitated in commission of the scam.

Considering the aforesaid facts and circumstances of the case and the period of custody, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge CBI II, Patna in Special Case No. 07 of 2019 cum RC 19A/2017.
