This is an application for grant of anticipatory bail in connection with Udwantnagar P.S. Case No.26 of 2023, registered for offences under Sections 341, 323, 336, 354 and 34 of the Indian Penal Code and 27 of the Arms Act.
The allegation is regarding the informant having gone to attend natural call in the morning on 17.01.2023, when the petitioners and one another co-accused person are alleged to have chased her with ill intention, however, somehow

The learned counsel for the petitioners has submitted that the petitioners are innocent and they have been falsely implicated in the present case.
The learned counsel for the petitioners has further submitted that the petitioners are accused in one another case in which they are on bail. The learned counsel for the petitioners has also submitted that superficial allegation has been levelled against the petitioners and in fact, no such incident had ever taken place. Per contra, the learned APP for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the materials available on record as also considering the fact that superficial sort of allegation has been levelled against the petitioners, I deem it fit and proper to admit the petitioners to the privilege of anticipatory bail.

No.30525 of 2023(2) dt.14-07-2023 3/3 Accordingly, the above named petitioners are directed to be enlarged on anticipatory bail, in the event of their arrest or surrender before the court below, within a period of four weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Udwantnagar P.S.
