2. The petitioner seeks regular bail in connection with Balia Belon P.S. Case No. 97 of 2023, lodged on 02.08.2023 under Sections 302, 498 (A), 120 (B) & 34 of the Indian Penal Code, pending in the Court of Additional Sessions Judge-V, Katihar.
3. Learned counsel for the petitioner submits that the regular bail application of the petitioner has earlier been rejected vide order dated 16.04.2024 passed in Cr. Misc. No. 10582 of 2024. Counsel submits that the lady on whose disclosure the informant reached at the petitioner's house, has not been examined by the police and only on strong suspicion, petitioner
Patna High Court CR. MISC. No.27269 of 2025(3) dt.01-08-2025 2/2 is in custody since 02.08.2023, having clean antecedent. Counsel submits that now the said person whose name is there in the FIR namely, Khanam Khatoon is now no more and petitioner is in custody.
4. Learned APP for the State opposes the prayer for bail of the petitioner and submits that in the earlier rejection order, it has been observed that all three dead bodies were recovered from the petitioner's house and dispute is going on which is indicated in the FIR.
5. In this view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
