JUSTICE PARTHA SARTHY ORAL ORDER 15-12-2020 Heard learned counsel for the appellant, learned Special Public Prosecutor for the State and learned counsel for the informant through video conferencing.
The appellant, who is an accused in Dharhara P.S. Case No. 21 of 2019 registered under sections 302 and other sections of the Indian Penal Code, section 27 of the Arms Act and section 3 of the SC & ST (Prevention of Actrocities) Act, has renewed his prayer for bail, the earlier appeal having been rejected by order dated 22.11.2019 (Annexure-1) passed in Cr. Appeal (SJ) No. 3659 of 2019.
A report was called for from the learned Court below with respect to the stage of the trial. The same has been received. As per the report contained in letter no. 10 dated
Patna High Court CR. APP (SJ) No.1706 of 2020(3) dt.15-12-2020 2/2 25.11.2020 the case is fixed for statement under section 313 of the Cr.P.C. and the trial is expected to conclude within three months.
In view of the allegation against the appellant of having resorted to firing upon the deceased along with one Santosh Yadav, the Court is not inclined to enlarge the appellant on bail.
The appeal is rejected.
