Renuka Ratnakar, learned A.P.P. The present petition has been filed with a prayer to restore Cr. Misc. No. 32842 of 2011, which stood dismissed on 13.2.2014 due to non- prosecution.

Learned counsel for the petitioner by way of referring to the statement made in paragraph no. 3 of the petition tried to persuade the court that due to bona fide mistake case was not marked and case stood dismissed whereas on perusal of the record it is evident that application was dismissed on 13.2.2014 and after more than two years the present petition for restoration was filed

Patna High Court Cr.Misc. No.37889 of 2016 (2) dt.31-08-2016 2/2 on 29.8.2016.

The court is not satisfied with the reasons mentioned in the restoration petition.

The restoration petition stands dismissed.
