The petitioner apprehends his arrest in Kouakol P.S. Case No. 54 of 2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named the petitioner and alleged that he contested the election and on the order of Dinesh Yadav, the petitioner Vikash Yadav assaulted Asha Devi, the daughter-in-law of the informant with iron rod on her head. Shambhu Ram assaulted the informant. Parmanand Prasad and Ramswarup Singh assaulted Chandan Kumar.

Learned counsel for the petitioner submits that Asha Devi and Chandan Kumar got simple injuries. There is no allegation of assault against the petitioner. On account of election

Considering the facts aforesaid and the fact that the petitioner is not the assailant, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawadah in Kouakol P.S. Case No. 54 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
