JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 406 and 420 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that informant himself had given the time to the petitioner to deposit the C.M.R. till 31.07.2016 but informant earlier to that filed a case against the petitioner on 26.07.2016. However, the petitioner has already deposited the said amount; a certificate to that effect has been issued by the Branch Manager of Bihar State Cooperative Bank Ltd., Patna, which is Annexure -3 to this application. Heard learned A.P.P. also.

Considering the submission, as above, this application is

Patna High Court Cr.Misc. No.51388 of 2016 (2) dt.14-12-2016 2/2 allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Singhwara P.S. Case No. 119 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
