The petitioner apprehends arrest in Pandaul P.S. Case No. 78 of 2017 instituted for the offence under Sections 341,323,307,504,34, 302 of the IPC.

In the written report, it is alleged that this petitioner along with two other accused persons dragged the son of the informant from his house and assaulted him with intention to kill with fists, slap etc. and thrashed him on the ground causing severe injury to the son of the informant. Thereafter, the son of the informant was taken to Pandaul hospital from where he was referred to Madhubani Hospital and after that he was taken to DMCH, Darbhanga and ultimately he died. Post-mortem report of the deceased shows that son of the informant has received

Patna High Court Cr.Misc. No.10469 of 2018(3) dt.10-04-2018 2/2 severe injuries.

In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law, without being prejudiced by this order.
