JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 4 of the Dowry Prohibition Act.

The prosecution case is that the daughter of the complainant was married to Brajesh Prajapati on 05.06.2010 subsequently he died, thereafter, in-laws family proposed the marriage of the daughter of the informant with Rakes Kumar, the younger brother of late husband of the daughter of the informant but subsequently marriage could not be solemnized. It is submitted by learned counsel for the petitioner that the petitioner is the other brother of Rakesh Kumar and now

Patna High Court Cr.Misc. No.56396 of 2015 (2) dt.11-12-2015 2/2 Rakesh Kumar has performed married with the daughter of the informant.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Dehri, Rohtas in connection with Complaint Case No. 109 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
